ShadowSnap Terms

These Terms are an agreement between you and Ludwig Chafen, doing business as Splash & Shadow Studio, Las Vegas, Nevada ("Splash & Shadow," "we," "us"). They cover the ShadowSnap app and the shop pages it makes. When you tick "I agree" in the app, or use ShadowSnap, you agree to these Terms. Our Privacy Policy explains what we collect and why.
If you don't agree, don't use ShadowSnap.
1. Who can use ShadowSnap
- You must be 13 or older.
- If you are under 18, a parent or guardian must agree to these Terms for you.
- New people need an invite code from us. If you used ShadowSnap on your iPhone before version 2.0 with one of our codes and we can match it, you don't need a new code: that code carries over. If we can't, we'll ask for an invite code.
- Give us true information, and keep it up to date in Settings > Account.
- One account per person. You can sign in to your account on more than one iPhone.
- Keep your iPhones and your Apple or Google account safe. You are responsible for what happens in your account, including on every iPhone signed in to it.
You can use ShadowSnap for your own collection or for your card business.
2. Access codes and switching off access
- Invite codes and access codes belong to us. A code keeps working until we switch it off. Don't sell invite codes.
- We may switch off a code or an account at any time, for example if it is misused or breaks these Terms.
- If we switch off your access, ShadowSnap stops working for your account and for every iPhone using that code. The app offers nothing else, including no export. The cards saved on your iPhone stay on your iPhone, but the app won't open them.
- Even then, you can ask us to delete your account. Email [email protected] from the email on your account.
- No signal? If you already use ShadowSnap, it keeps working, and you sign in next time you have a connection. Signing up for the first time needs a connection. An outage on our side never counts against you.
- Sign in with Apple and Sign in with Google are run by Apple and Google. Their own terms apply to them.
3. Your Inventory and backups
- Your records are yours. Your cards, prices, costs, collections, shows, and stickers belong to you. You give us permission to store, copy, back up, and process them so we can run ShadowSnap for you, bring them back on another iPhone, and show your shop page.
- Moving into 2.0 doesn't rewrite or delete the files on your iPhone. It adds a small file that says where each card lives, and you can undo it in Settings > Account ("Put my cards back like before 2.0").
- Backups are a help, not a promise. We work hard to keep them safe, but a backup can fail, be incomplete, or be lost. Keep your own copy too: export your Inventory as a spreadsheet (CSV) from time to time.
- Restoring: during testing, a backup can only be brought back onto an iPhone that has no cards on it.
- Backups don't yet include photos or scan history.
4. Scans and card photos
- When you scan a card, or pick a photo from your library to find cards in it, the photo goes to our server so we can identify the cards.
- You give us permission to keep your scan photos, the photos you pick, scan results, and correction taps, and to use them to run and improve ShadowSnap, including to make card recognition better. This permission lasts even after you delete your account.
- Only scan cards and products. Don't scan people, documents, or anything you don't have the right to photograph.
5. Shop pages
How they work
- If you sell cards, ShadowSnap makes you a public shop page. It is on automatically and has no off switch while your account is open.
- If you collect, you have no page unless you turn one on. A collector's page shows only your Vault, without prices. You can turn it off again.
- Anyone with the link or your booth QR code can see your page. Our Privacy Policy lists exactly what it shows and what it never shows. In short, a seller's page shows your shop name, the shows you'll be at, and the cards in your collections and shows at their sticker prices. It never shows your costs, sales, profit, or real name. Your Vault stays hidden unless you switch it on.
Your responsibilities as a seller
- Your shop name and everything on your page are your responsibility.
- The prices are yours. ShadowSnap works them out from your printed stickers, your pinned prices, and your pricing settings. Check them.
- List only real items. Never present fake, counterfeit, altered, or proxy cards as real.
- Shop names must not be hateful, sexual, violent, or harassing. They must not pretend to be someone else, use someone else's private information, or use someone else's brand in a confusing way.
- Follow the law that applies to your sales, including sales tax and consumer rules.
We are not part of your sales
- ShadowSnap shows information. It doesn't take payments, hold money, ship, or guarantee any card, price, or seller. Buyers and sellers deal with each other directly, and any dispute between them is theirs to settle.
- A shop page shows prices as of the time it was last updated. The seller decides the final price.
Taking pages down
- Every page has a "Report this page" link to [email protected].
- We don't allow objectionable content on shop pages. We review reports and act on objectionable pages within 24 hours.
- We may hide any page, or refuse any shop name, at any time, for example if it breaks these Terms.
6. Prices and information
Market values, price history, sell speed, grading information, Insights, profit pages, and show reports are estimates from public sources and our own math. They can be wrong, late, or missing. Card identification can be wrong too. Check before you buy, sell, trade, or send a card for grading.
Nothing in ShadowSnap is financial, investment, tax, legal, or grading advice. Reports in ShadowSnap are not tax records. Talk to a tax professional about your taxes.
7. Rules for using ShadowSnap
Don't:
- break the law, or use ShadowSnap to harm, harass, or cheat anyone
- try to get around access codes, switches, rate limits, or other limits
- use someone else's account or code without their permission
- copy our catalog, prices, or recognition in bulk, scrape our servers, or resell our data
- take apart or copy the app or our servers, except where the law allows it
- overload, attack, or interfere with our servers, or upload anything harmful
- pretend to be someone else
8. Email and text messages
Both are optional. Saying no never changes what ShadowSnap does for you.
Email. The box says: "Email me news and deals from Splash and Shadow (splashandshadow.com, [email protected]). Unsubscribe anytime." You can unsubscribe from any email, switch off "Deals by email" in Settings > Account, or write to us.
Texts. The box always starts unticked. It says: "Text me deals and news from Splash and Shadow. I agree to get recurring marketing texts, which may be sent by automated technology, at the mobile number above. Agreeing is not required to use ShadowSnap or to buy anything. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. See Terms and Privacy."
The text program works like this:
- What: news and deals from Splash & Shadow, sent to the mobile number on your account.
- How often: it varies.
- Cost: message and data rates may apply, depending on your mobile plan.
- Stopping: reply STOP to any text. You can also switch off "Deals by text" in Settings > Account, or email [email protected]. Any reasonable way of telling us works.
- Help: reply HELP, or email [email protected].
- Confirming: before the first marketing text, we'll send one text asking you to confirm.
- Not needed: agreeing is not required to use ShadowSnap or to buy anything.
- Carriers: mobile carriers are not responsible for delayed or undelivered messages.
- New number: if you change your mobile number in Settings, texts stay off for the new number until you tick the box again.
- Privacy: we don't share your number or your choice with anyone else for their marketing. See our Privacy Policy.
Today we don't send any marketing email or texts at all.
We may also email you, or call you, about your account or your shop page. Those messages aren't marketing.
9. Our app and content
ShadowSnap, our servers, the card catalog, price data, card recognition, and our designs and names belong to us or the companies we license them from. We give you a personal, limited, non-exclusive, non-transferable permission to use ShadowSnap on iPhones you own or control, under these Terms and Apple's rules. We can end this permission as described in section 2.
Pokémon and other game names, and the names of grading companies, marketplaces, and price sources, belong to their owners. ShadowSnap is not affiliated with or endorsed by them.
If you send us ideas or feedback, we may use them freely.
10. Test versions
Test versions, including TestFlight builds, may have bugs, may lose data, and may change or stop without notice. We may switch any feature off at any time. Use them at your own risk, and keep your own spreadsheet (CSV) copy of your cards.
11. A free service that can change
ShadowSnap is free. If we ever decide to charge for something, we'll tell you first, and you'll choose whether to pay.
We may change, pause, or end ShadowSnap or any part of it. You can stop using ShadowSnap at any time.
12. Deleting your account
You can delete your account in the app: Settings > Account > Delete account.
- Every iPhone on your account is signed out right away, and your shop page closes.
- Your account waits 30 days in case you change your mind. Sign in before the date the app shows and tap "Keep my account."
- After 30 days your account is erased as our Privacy Policy describes. Scans and scan photos stay (section 4).
- Your iPhone keeps its cards.
13. No promises beyond these Terms
ShadowSnap, its backups, its shop pages, and all prices and information in it are provided "as is" and "as available." As far as the law allows, we make no promises of any kind, express or implied, including that ShadowSnap will be accurate, available, error free, or fit for a particular purpose, or that your data will never be lost.
Some places don't allow some of these limits. Where that's the case, they apply only as far as the law allows.
14. Limits on our responsibility
As far as the law allows:
- We are not responsible for indirect or consequential losses, including lost profits, lost sales, lost data, or a bad buy, sale, trade, or grading decision.
- Our total responsibility for any claim about ShadowSnap is limited to the greater of $50 or the amount you paid us in the 12 months before the claim.
Nothing here limits responsibility that the law doesn't allow us to limit.
15. Covering our costs
If your shop page, your listings, your content, or your breaking these Terms leads to a claim against us, you agree to cover our reasonable costs, including legal fees, as far as the law allows.
16. Disagreements
If something goes wrong, email [email protected] first and give us 30 days to try to fix it.
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. Any dispute goes to the state or federal courts in Clark County, Nevada, and you and we agree to those courts. Either of us may use small claims court instead, if the claim qualifies.
17. Apple
- These Terms are between you and us, not Apple. We, not Apple, are responsible for ShadowSnap and its content.
- Apple has no duty to provide any support or maintenance for ShadowSnap.
- If ShadowSnap fails to meet a promise that applies to it, you may tell Apple, and Apple will refund the price you paid for it (ShadowSnap is free). Apple has no other promise to keep about ShadowSnap, as far as the law allows.
- We, not Apple, handle any claims about ShadowSnap, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims.
- If someone claims that ShadowSnap breaks their intellectual property rights, we, not Apple, are responsible for dealing with it.
- You confirm that you are not in a country under a United States government embargo, or named as a terrorist supporting country, and that you are not on any United States government list of prohibited or restricted parties.
- Follow the terms of any other service you use with ShadowSnap, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Apple's standard license for App Store apps also applies. Where it and these Terms differ, these Terms apply between you and us.
18. Changes to these Terms
We may change these Terms. When we do, we'll update this page and the date at the top. If a change matters, we'll tell you in the app and ask you to agree again before you keep using your account. We keep a copy of each version and a record of which version you agreed to.
19. Other legal points
- These Terms, our Privacy Policy, and Apple's standard license are the whole agreement between you and us about ShadowSnap.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part of these Terms right away, we can still enforce it later.
- We may transfer these Terms to a company that takes over ShadowSnap. You can't transfer your account or these Terms.
- We may send you notices in the app or by email.
- Sections 3, 4, 6, 9, and 13 to 19 keep applying after your account ends.
